KATHMANDU: The Supreme Court has issued a show cause order on separate writ petitions filed by five Madhesh Province Assembly members who were subjected to action by the Provincial Assembly Secretariat.
A single bench of Justice Nityananda Pandey issued the order on Monday. The bench also issued a short-term interim order and summoned both parties for a hearing.
The five lawmakers, who were relieved of their positions by the Provincial Assembly Secretariat for remaining absent from the assembly meeting for ten consecutive sessions without notifying the secretariat, had filed separate writ petitions at the Supreme Court seeking an interim order against the decision.
On November 13, the secretariat published a notice removing Manish Kumar Suman, Sanjay Yadav, Singhansan Sah Kalwar, and Sarda Shankar Prasad Kalwar of the Janata Samajbadi Party (JSP) Nepal, as well as Urmila Devi Singh of the Nagarik Unmukti Party, from their positions. The notice of their removal has already been published in the Provincial Gazette.
These five assembly members had filed separate writ petitions at the Supreme Court, alleging that Speaker Ram Chandra Mandal had put pressure on the Secretary of the Secretariat, Basu Prasad Koirala, to remove them due to political prejudice.
The dismissal notice came after the seven-party coalition brought a motion to remove Speaker Mandal for showing behaviour inconsistent with the dignity of his office.
