KATHMANDU: The writ petition filed by Madhesh Province Assembly members demanding the annulment of Chief Minister Saroj Yadav’s appointment will be heard by a division bench of the Supreme Court.
Hearing the petition on Wednesday, a single bench of Justice Nityananda Pandey ordered that the case be referred to a division bench.
The division bench is hearing the case on Sunday.
A total of 74 lawmakers from seven political parties in the Madhesh Provincial Assembly jointly filed the petition seeking to nullify the appointment of Saroj Yadav, the parliamentary party leader of the CPN-UML, as the Chief Minister.
The petition was filed under the leadership of Krishna Prasad Yadav of the Nepali Congress, Saroj Kumar of the Janata Samajbadi Party (JSP) Nepal, Yubaraj Bhattarai of the CPN (Maoist Center), and Jayalun Rain of the Loktantrik Samajbadi Party (LSP) Nepal, among others.
Earlier, the Supreme Court had issued an interim order restraining Chief Minister Yadav from taking any decisions that could have long-term effects. The order was issued by a single bench of Tek Prasad Dhungana during the preliminary hearing of another petition filed by Raki Prasad Sah and others.
Meanwhile, seven political parties have launched street protests in Janakpur since Tuesday, claiming that Yadav’s appointment as Chief Minister was unconstitutional.
Leaders and cadres from all seven parties have been staging sit-ins and demonstrations in front of the Chief Minister’s Office, demanding his resignation.
