KATHMANDU: The Supreme Court has registered a writ petition filed by Nepali Congress (NC) lawmakers demanding the reinstatement of the House of Representatives.
The petition, submitted two days ago, was registered on Tuesday after review.
Eight lawmakers, including NC’s chief whip and whip of the dissolved house, Shyam Kumar Ghimire and Sushila Thing, respectively, filed the petition.
According to Supreme Court Joint Registrar Arjun Prasad Koirala, the top court will conduct a preliminary hearing on January 17.
In the petition, the lawmakers have claimed that the interim government led by Sushila Karki is unconstitutional. They have demanded that all election-related activities be halted and sought a mandamus order in the name of the President to form a new government under Article 76 of the Constitution of Nepal, 2015.
The petitioners argue that after KP Sharma Oli resigned, the President failed to form a new government and instead unconstitutionally appointed Sushila Karki as prime minister. They have demanded that her appointment, oath of office, and the dissolution of the House be annulled.
Earlier, UML lawmakers had also filed a similar writ at the Supreme Court.
