KATHMANDU: The Supreme Court has dismissed writ petitions filed against the appointment of KP Sharma Oli as the Prime Minister.

The constitutional bench of the apex court took the decision on Wednesday.

Three writ petitions were filed on July 29, claiming that Oli’s appointment as Prime Minister under Article 76(2) of the Constitution of Nepal was unconstitutional. The petitioners argued that after a Prime Minister appointed under Article 76(2) fails to secure a vote of confidence, the process should automatically move to Clause (3), under which the leader of the largest party in Parliament should be appointed Prime Minister.

The Constitutional Bench, comprising Chief Justice Bishwambhar Prasad Shrestha and Justices Prakash Man Singh Raut, Sapana Malla Pradhan, Prakash Kumar Dhungana and Kumar Regmi decided to dismiss all the writ petitions.

Earlier, a single bench of Justice Bal Krishna Dhakal decided to send the case to the constitutional bench after a preliminary hearing.
