SC bars further remand extension for Oli, Lekhak

KATHMANDU: The Supreme Court has ordered authorities not to extend the remand of former Prime Minister KP Sharma Oli and former Home Minister Ramesh Lekhak any further.

A division bench of Justices Binod Sharma and Sunil Kumar Pokharel on Monday dismissed separate habeas corpus petitions filed on behalf of Oli and Lekhak, and issued a mandamus order, stating that the remand, already extended for a third time, must not be prolonged further.

“The investigation must be completed and a decision taken on whether to file a case within the time frame granted by the Kathmandu District Court, which had allowed a third extension of five days effective from April 4. If the case is not filed by that time, the two must be released from custody following due legal procedures, while further investigation can continue as required,” the order states.

Police arrested Oli and Lekhak on March 28, one day after the new government assumed office, as per the recommendation of a high-level commission formed to probe the incidents of September 8 and 9.

Oli’s wife, Radhika Shakya, and Lekhak’s spouse, Yashoda, had filed the petitions on March 29.
