HC quashes KMC’s decision to scrap waste management agreement with Nepwaste

KATHMANDU: The Patan High Court has annulled the Kathmandu Metropolitan City’s unilateral decision to halt its agreement with Nepwaste Pvt Ltd for solid waste management in the Kathmandu Valley.

Hearing a writ petition against the decision filed by Nepwaste Pvt Ltd, a division bench of High Court Judges Chandra Mani Gyawali and Hemanta Rawal issued a mandamus order to defendants, including the Office of the Prime Minister and Council of Ministers, directing them to immediately resume the stalled project and ensure necessary coordination for its implementation.

“Since the project is to be fully implemented through foreign investment without utilizing tax revenues collected from Nepali citizens, and this is clearly stated in the Project Developmet Report (PDR), a directive order has also been issued in the name of the Chief Secretary of the Government of Nepal to extend necessary support and coordination for the operation of this project of national interest,” the high court order reads.

A directive order has been issued in the name of KMC and other municipalities in the Valley to facilitate the project by embracing the principles of relationship, cooperation, coexistence and coordination between the federal and local levels.

Likewise, the CEO of the Investment Board Nepal has been told to submit a written progress report on the implementation of the order within three months.
