KATHMANDU: The Supreme Court could not complete the hearing of a case related to the appointment of Madhesh Chief Minister Saroj Yadav on Thursday.
Advocate Rakki Prasad Sah, one of the petitioners, said the case has been put on ‘ongoing hearing’ status and that the hearing will continue on Friday. “Legal practitioners of the petitioners completed pleading on Thursday. Since some legal practitioners representing defendants could not complete their arguments, the hearing will resume on Friday,” Sah said.
A division bench of Justices Hari Prasad Phuyal and Nityananda Pandey is hearing the case.
The Supreme Court is simultaneously hearing three separate writ petitions filed against Yadav’s appointment.
Earlier, on December 18, the apex court ordered the opposing parties to submit a written response by November 25. The court also ordered the provincial government not to make any policy decisions that could have a long-term impact until the final verdict is passed.
Seventy-four members of the Madhesh Provincial Assembly filed a writ petition in the Supreme Court on November 10, challenging the Province Chief’s decision to appoint Yadav as Chief Minister under Article 168(3) of the Constitution of Nepal, 2015.
Then Province Chief, Sumitra Subedi Bhandari, appointed Yadav in the evening of November 9 and administered the oath of office at a hotel in Bardibas at 4 am the next day.
Bhandari has since been relieved of her duties by the federal government.
