KATHMANDU: The Supreme Court has refused to issue an interim order on a writ petition filed by Kishori Sah, the candidate of the Rastriya Swatantra Party (RSP) from Dhanusha-1 of the House of Representatives.
A division bench of Justices Binod Sharma and Meghraj Pokharel issued the order on Sunday.
The Election Commission (EC) had scrapped Sah’s candidacy three days before the elections held on March 5 after a complaint was filed against him stating that his name was on the blacklist of the Credit Information Bureau (CIB).
Challenging the decision, Sah had filed a writ petition at the Supreme Court.
The apex court’s refusal to grant an interim order effectively upheld the EC’s decision to scrap his candidacy.
Even after scrapping Sah’s candidacy, the EC conducted the election in the constituency with Sah’s election symbol, the bell, still on the ballot. It counted the ballots received by Sah but did not make the results public.
EC sources say the votes received by Sah were far higher than those received by second-placed Matrika Prasad Yadav of the Nepali Communist Party (NCP). However, since his candidacy had already been scrapped, the EC has declared Yadav elected from the constituency.
