Parliament’s general secretary sends replies to Supreme Court

KATHMANDU: Federal Parliament’s General Secretary Bharat Raj Gautam has responded to queries raised by the Supreme Court.

Earlier on Wednesday, Gautam wrote a letter to different government agencies, including the apex court, stating that the impeachment motion against Chief Justice Cholendra Shamsher Rana is no longer in effect.

Immediately after receiving the letter, the Supreme Court had asked Gautam on what legal and constitutional grounds the motion was declared ineffective.

Devendra Dhakal, the information office at the Supreme Court, confirmed that the apex court has received a letter sent by the Federal Parliament Secretariat. “We have received the letter. It has been forwarded to the Registrar,” he told Himal Press.

In the letter, Gautam said he would respond to apex court’s queries in the constitutional bench of the Supreme Court.

Nepal Bar Association President Purna Man Shakya and eight others had moved the apex court against Gautam’s letter. Responding to the petition, the Supreme Court Friday issued an interim order asking authorities to not implement the letter written by Gautam that said the impeachment motion against Chief Justice Cholendra Shamsher Rana had become ineffective.

A constitutional bench of Acting Chief Justice Hari Krishna Karki and Justices Bishwambhar Prasad Shrestha, Ishwar Prasad Khatiwada, Dr Ananda Mohan Bhattarai and Anil Kumar Sinha had issued the order.

Rana was preparing to assume his office at Supreme Court on the basis of Gautam’s letter. But he couldn’t reach Supreme Court has the government refused to make security arrangements for him.
