KATHMANDU: The Supreme Court has issued a mandamus order in the name of the government to form two commissions related to transitional justice within a month.

A division bench of Justices Kumar Regmi and Mahesh Sharma Poudel issued a certiorari order on January 29 after hearing a writ petition filed by people affected by the decade-long armed conflict. The full text of the order was made available on Tuesday.

“This mandamus order has been issued in the name of the government to begin the process of appointing office-bearers in the Truth and Reconciliation Commission and the Commission of Investigation on Enforced Disappeared Persons by forming a nomination committee within a month of receiving this order,” the apex court verdict reads.

Likewise, the Supreme Court has decided to write to the Office of the Prime Minister and Council of Ministers to make necessary arrangements and create an environment for the secretaries of the commissions to launch preliminary investigations on complaints filed by the victims, even if office-bearers have not been appointed, within 15 days of receiving the order.
