Don’t implement parliament secretariat’s letter, says apex court

KATHMANDU: The Supreme Court Friday issued an interim order asking authorities to not implement the letter written by Federal Parliament Secretariat’s General Secretary Bharat Raj Gautam that said the impeachment motion against Chief Justice Cholendra Shamsher Rana had become ineffective.

A constitutional bench of Acting Chief Justice Hari Krishna Karki and Justices Bishwambhar Prasad Shrestha, Ishwar Prasad Khatiwada, Dr Ananda Mohan Bhattarai and Anil Kumar Sinha issued the order to not execute the letter issued by General Secretary of the Federal Parliament Secretariat who does not have a constitutional status.

The bench was hearing a writ petition filed by Nepal Bar Association President Purna Man Shakya and eight other others.

The parliament secrwetariat’s letter could have paved the way for Rana’s reinstatement.

Gautam had sent a letter to the Office of the President, the Office of the Prime Minister and the Council of Ministers, the Supreme Court and other agencies on Wednesday, stating that the impeachment motion has become ineffective.

Rana has remained suspended since the impeachment motion against him was filed on February 13. Gautam’s letter could have paved the way for his reinstatement.
