Budhanilkantha mayor, two ward chairs sentenced to one month in prison

KATHMANDU: Kathmandu District Court has sentenced Mayor Mitharam Adhikari as well as two ward chairpersons and ward committee member to one month in prison in a contempt of court case.

A single bench of District Judge Dr Rajendra Kumar Acharya passed the verdict on, hearing a contempt of court case filed by Chandra Bahadur Thapa.

Thapa had made Mayor Adhikari, Ward No.10 Chairperson Navaraj Bhattarai, Ward No. 8 Chairperson Suman Tamang, and Ward No.10 Committee Member Chandra Man Shrestha defendants in the case.

“A sentence of one month in prison is handed to the defendants as per Section 238 (16) of the National Civil Code (Procedures), 2017, for not abiding by the court order and hesitating to execute the court’s verdict,” the district court’s order reads.

The court has also stated that if the court’s previous verdict is executed in 60 days, the defendants won’t have to spend time in jail.

Earlier in November 2023, the district had issued an order against the municipality in a land dispute. Landowner Thapa had filed a contempt of court case against the Mayor, ward chairpersons and a ward committee member after the municipality failed to release the land within 100 days of the verdict.
