Decision to withdraw cases against Rabi challenged in SC

KATHMANDU: A writ petition has been filed at the Supreme Court challenging a decision of the Office of the Attorney General to money laundering and organised crime cases against Rastriya Swatantra Party (RSP) Chairperson Rabi Lamichhane.

Advocate Yuvraj Paudel filed the petition, naming the Office of the Attorney General, various District Government Attorney Offices, and Lamichhane as defendants.

The petitioner has sought an order of certiorari to quash the decision made by the Office of the Attorney General on January 14.

Similarly, the petitioner has demanded a writ of mandamus, demanding that no obstruction be created in the resolution of cases involving Lamichhane.

The plaintiff has claimed that the decision was arbitrary and taken with the intention of granting Lamichhane immunity, despite legal provisions under Section 36 of the National Criminal Procedure Code, 2017, which prohibit amendment of charges except in cases where new evidence has been discovered.
