KATHMANDU: General Secretary of the Federal Parliament Secretariat Bharatraj Gautam has begun consultations to respond to the Supreme Court’s queries over the secretariat’s letter that said the impeachment motion against Chief Justice Cholendra Shamsher Rana is no longer valid.
Sources say Gautam is holding discussions with Secretary and Spokesperson, among others.
Gautam had sent a letter to concerned authorities on Wednesday stating that the impeachment motion against Rana was no longer valid. Taken aback by the letter, the Supreme Court Justices discussed the matter on the same day and wrote a letter to the parliament’s General Secretary, asking the latter to clarify some issues.
The Supreme Court has asked the parliament secretariat on what legal or constitutional grounds the impeachment motion was declared ineffective.
The apex court has mainly raised four questions. First, whether any action is being taken on the report of the Impeachment Recommendation Committee submitted to the House of Representatives. Second, whether the impeachment motion will be tabled in the new House of Representatives. Likewise, the Supreme Court has asked the parliament secretariat to clarify whether the impeachment motion became invalid because of the end of the term of the House of Representatives or because of the election date.
Fourth, the Supreme Court has asked the parliament secretariat on what legal or constitutional grounds the impeachment motion was declared ineffective.
Sources at the parliament secretariat say senior officials of the secretariat are dissatisfied with the general secretary for sending the letter without consulting with them.
